Terms of sale
The owner of the webshop Open Your Eyes (hereinafter the Webshop) is OpenYourEyes OÜ (registry code EE103011404), located at Poordi tn 3-12, Kesklinna District, Tallinn, Harju County, 10156, Estonia.
Validity of the Sales Contract, Product and Price Information
These terms of sale apply to purchases made from the Webshop.
The prices of products sold in the Webshop are indicated next to the products. A delivery fee is added to the price. All prices of goods sold in the Webshop are in euros.
The delivery fee depends on the buyer’s location and the chosen delivery method. The delivery fee is displayed to the buyer when placing the order.
Information about the product is provided in the Webshop directly next to the product.
Placing an Order
To order goods, the desired products must be added to the shopping cart. To complete the order, the required data fields must be filled in and a suitable delivery method selected. The amount payable is then displayed on the screen, which can be paid securely via the following payment methods:
- Estonian bank transfers
- Visa/Mastercard card payments
- Apple Pay and Google Pay
NB! When paying via bank link, be sure to click the “Back to merchant” button on the bank’s page.
Payments are processed by Maksekeskus AS. Payment takes place outside the Webshop in a secure environment – when paying via bank link, in the respective bank’s secure environment, and when paying by credit card, in Maksekeskus AS’s secure environment. The seller has no access to the customer’s bank or credit card details. The contract enters into force once the amount due has been received in the Webshop’s bank account.
The owner of the Webshop is the controller of personal data and transfers the personal data necessary for processing payments to the authorized processor, Maksekeskus AS.
If the ordered goods cannot be delivered due to the goods being out of stock or for another reason, the buyer will be notified at the first opportunity and the amount paid (including delivery costs) will be refunded without delay, but no later than within 14 days of sending the notice.
Delivery
Goods are shipped to Estonia and abroad (primarily to Europe, but shipping to North America and other countries is not excluded).
The buyer has the following options for receiving the goods:
- Parcel machine (Omniva, Smartpost, or DPD)
- Courier delivery
Shipping costs are borne by the buyer, and the relevant price information is displayed next to the shipping method.
Domestic shipments generally reach the destination specified by the buyer within 5-7 business days from the entry into force of the sales contract. Jewelry is an exception to this category – as these products are handcrafted to order (custom-made), their delivery time is on average up to one month.
Delivery outside Estonia generally takes place within 14 calendar days.
In exceptional cases, the Webshop reserves the right to deliver the goods within up to 45 calendar days.
Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-shop within 14 days.
The right of withdrawal does not apply to the following products:
- Jewelry – these are personalized products manufactured according to the customer’s specifications, pursuant to § 53 (4) point 3 of the Estonian Law of Obligations Act. Jewelry can only be returned if it arrives defective.
- Digital content (audiobooks, e-books, and courses) – pursuant to § 53 (4) point 7 of the Estonian Law of Obligations Act, provided that the downloading, use, or availability of the digital content began before the end of the withdrawal period with the buyer’s express prior consent and confirmation that they thereby lose their right of withdrawal.
The right of withdrawal applies to physical books, subject to the conditions described below.
The right of withdrawal does not apply if the buyer is a legal entity.
To exercise the 14-day right of return, the ordered goods must not be used in any way other than is necessary to establish the nature, characteristics, and functioning of the goods, in the manner permitted for testing goods in a physical store.
If the goods have been used for purposes other than establishing their nature, characteristics, and functioning, or show signs of use or wear, the Webshop has the right to reduce the refundable amount in proportion to the decrease in value of the goods.
To return goods, a withdrawal application must be submitted, the form for which can be found here: https://openyoureyes.love/withdrawal/
and sent to the email address info@openyoureyes.love no later than 14 days after receiving the goods.
The costs of returning the goods are borne by the buyer, except in cases where the reason for the return is that the returned product does not match what was ordered (e.g. a wrong or defective product).
The buyer must return the goods within 14 days following the submission of the application, or provide proof that they have handed over the goods to the carrier within the aforementioned period.
Upon receipt of the returned goods, the Webshop will refund the buyer, without delay but no later than within 14 days of receiving the withdrawal application, all payments received from the buyer under the contract.
The Webshop may refuse to make refunds until it has received the goods that were the subject of the contract, or until the buyer has provided proof that the goods have been sent back, whichever occurs first.
If the buyer has explicitly chosen a delivery method other than the cheapest standard delivery method offered by the Webshop, the Webshop is not required to refund the consumer any costs exceeding those associated with the standard delivery method.
The Webshop has the right to withdraw from the sales transaction and demand the return of the goods from the buyer if the price of the goods in the Webshop was, due to an error, set significantly below the market price of the goods.
Right to File a Claim
The Webshop is liable for any non-conformity or defect in the goods sold to the buyer that existed at the time of delivery and that becomes apparent within two years from the delivery of the goods to the buyer. Within 1 year from the delivery of the goods to the buyer, it is presumed that the defect already existed at the time of delivery. The burden of rebutting this presumption lies with the Webshop.
In the event of a defect, the buyer has the right to contact the Webshop no later than within two months, by sending an email to info@openyoureyes.love or calling +372 508 8840.
The Webshop is not liable for defects that arise after the goods have been delivered to the buyer.
If goods purchased from the Webshop have defects for which the Webshop is liable, the Webshop will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Webshop will refund the buyer all payments made under the sales contract.
The Webshop will respond to a consumer complaint in writing or in a format that allows written reproduction within 15 days.
Direct Marketing and Processing of Personal Data
The Webshop uses the personal data entered by the buyer only for processing the order and sending the goods to the buyer. The Webshop transfers personal data to shipping companies for the purpose of delivering the goods.
The Webshop sends newsletters and offers to the buyer’s email address only if the buyer has expressed a wish to do so by entering their email address on the website and indicating their wish to receive direct marketing messages.
The buyer may at any time opt out of receiving offers and newsletters by email, either by notifying us by email or by following the instructions provided in the email containing the offers.
Dispute Resolution
If the buyer has any complaints regarding the Webshop, they should be sent to the email address info@openyoureyes.love or by calling +372 508 8840.
If the buyer and the Webshop are unable to resolve the dispute by agreement, the buyer may turn to the Consumer Disputes Committee. The procedural conditions can be reviewed and an application submitted here. The Consumer Disputes Committee is competent to resolve disputes arising from contracts concluded between the buyer and the Webshop. Review of the buyer’s complaint by the Committee is free of charge.
The buyer may also turn to the European Union’s Online Dispute Resolution platform.
